1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us. This includes:

  • Shipping and Fulfilment Partners. We share your name and delivery address with our logistics and shipping partners to fulfil your orders.
  • Shopify. Our store is hosted on Shopify Inc., which acts as a data processor on our behalf. Shopify's privacy policy is available at https://www.shopify.com/legal/privacy.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider, which may include your name, email address, friends list, and profile picture.

We will use the information we receive only for the purposes described in this Privacy Notice. We do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. 6. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our store is hosted on Shopify Inc., whose servers are located in the United States. Your information may be transferred to, stored by, and processed by us and our third-party partners in the United States and other countries.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), Switzerland, or Canada, please be aware that these countries may not have data protection laws as comprehensive as those in your country. We will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law, including:

  • Standard Contractual Clauses approved by the European Commission (for EEA residents)
  • The UK International Data Transfer Agreement (IDTA) (for UK residents)
  • Switzerland's Federal Act on Data Protection (nFADP) transfer mechanisms (for Swiss residents)
  • Appropriate contractual safeguards in accordance with PIPEDA (for Canadian residents)

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We retain your personal information only as long as necessary for the purposes set out in this Privacy Notice. Our specific retention periods are as follows:

  • Order and transaction data: minimum 7 years, to comply with Swiss financial and tax regulations.
  • Account data: for the duration of your account, plus up to 2 years after account closure for fraud prevention purposes.
  • Marketing data: until you withdraw consent or opt out of marketing communications.
  • Technical/analytics data: up to 26 months, in line with standard analytics retention practices.
  • Customer support records: up to 3 years after resolution of the support request.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it. If deletion is not immediately possible (for example, data stored in backup archives), we will securely store and isolate it from further processing until deletion is possible.


8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us using the details in Section 15. This will not affect the lawfulness of processing carried out before withdrawal.

Account Information

To review or change the information in your account or to terminate your account, contact us at support@iconicoutfitters.com. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases, subject to retention obligations described in Section 7.

10. CONTROLS FOR DO-NOT-TRACK FEATURES AND GLOBAL PRIVACY CONTROL

Most web browsers include a Do-Not-Track ("DNT") feature you can activate to signal your privacy preference. As no uniform technology standard for DNT has been finalized, we do not currently respond to DNT signals. If a standard is adopted that we must follow, we will update this Privacy Notice accordingly.

Global Privacy Control (GPC)

We honor Global Privacy Control (GPC) signals. If your browser or browser extension sends a GPC signal when you visit our website, we will treat it as a valid opt-out request from the sale or sharing of your personal information, as required under the California Privacy Rights Act (CPRA) and other applicable privacy laws. This means we will not sell or share your personal data for cross-context behavioral advertising when a GPC signal is detected.

11. GDPR — SPECIFIC INFORMATION FOR EU RESIDENTS

If you are located in the European Union or European Economic Area, the following applies to you under the General Data Protection Regulation (GDPR).

Legal Basis for Processing

We process your personal data on the following legal bases:

  • Contract performance: processing necessary to fulfil your order and deliver products to you.
  • Legal obligation: processing required to comply with our legal and regulatory obligations.
  • Legitimate interests: processing necessary for our legitimate business interests such as fraud prevention, improving our services, and direct marketing to existing customers, where not overridden by your rights.

  • Right to Data Portability — receive your data in a structured, commonly used, machine-readable format.
  • Right to Object — object to processing based on legitimate interests or for direct marketing.
  • Right to Withdraw Consent — withdraw consent at any time without affecting prior lawful processing.

Swiss Data Protection (nFADP)

As a Swiss-registered company, we also comply with Switzerland's revised Federal Act on Data Protection (nFADP), which came into force on 1 September 2023. Swiss residents have substantially similar rights to those listed above under GDPR. For questions regarding Swiss data protection, you may also contact the Federal Data Protection and Information Commissioner (FDPIC) at www.edoeb.admin.ch.

UK GDPR

If you are located in the United Kingdom, your personal data is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. 12. CCPA/CPRA — SPECIFIC INFORMATION FOR CALIFORNIA RESIDENTS

If you are a California resident, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) provides you with the following rights.

Your California Rights

  • Right to Know: you may request details about the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the third parties with whom we share it.
  • Right to Delete: you may request deletion of your personal information, subject to certain exceptions.
  • Right to Correct: you may request that we correct inaccurate personal information we hold about you.
  • Right to Opt Out of Sale/Sharing: you have the right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising. We honor GPC signals as a valid opt-out (see Section 10).
  • Right to Limit Use of Sensitive Personal Information: you may limit our use of sensitive personal information to necessary purposes (note: we do not currently process sensitive personal information).
  • Right to Non-Discrimination: we will not discriminate against you for exercising any of your CCPA/CPRA rights.

CalOPPA

In accordance with the California Online Privacy Protection Act (CalOPPA): users can visit our site anonymously; we include a link to this Privacy Notice that includes the word "Privacy" and is easily found; users will be notified of any privacy policy changes on this page; users can change their personal information by contacting us.

How to Exercise Your California Rights

To submit a California privacy rights request, contact us at support@iconicoutfitters.com with the subject line "California Privacy Request." We will respond within 45 days as required by law.


13. PIPEDA — SPECIFIC INFORMATION FOR CANADIAN RESIDENTS

If you are located in Canada, your personal information is protected under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. We are committed to handling your personal information in accordance with PIPEDA's 10 fair information principles.

Your Rights Under PIPEDA

As a Canadian resident, you have the right to:

  • Access your personal information — request a copy of the personal information we hold about you and information about how it has been used and disclosed.
  • Correct inaccuracies — request that we correct or update your personal information if it is inaccurate, incomplete, or out of date.
  • Withdraw consent — withdraw your consent to the collection, use, or disclosure of your personal information at any time, subject to legal and contractual restrictions. Note that withdrawing consent may affect our ability to provide you with certain products or services.
  • Know the purpose — be informed of the purposes for which your personal information is collected, used, and disclosed before or at the time of collection.
  • Lodge a complaint — file a complaint with the Office of the Privacy Commissioner of Canada (OPC) if you believe we have not complied with PIPEDA.

We obtain your consent for the collection, use, and disclosure of your personal information, except where permitted or required by law. In some cases, consent may be implied (for example, providing your shipping address implies consent for us to share it with our shipping partner to deliver your order).

Canada's Anti-Spam Legislation (CASL)

If you are a Canadian resident, we will only send you commercial electronic messages (marketing emails, promotional messages) if you have given express or implied consent in accordance with Canada's Anti-Spam Legislation (CASL).
